Elders’ Right to Sue

Activists have strong opposition in their effort to block the Trump Administration’s actions that are harmful to seniors. The actions, announced in June and proposed by the Centers for Medicare and Medicaid Services (CMS), would eliminate a rule implemented during the Obama Administration that allows nursing home residents to sue facilities over abuse, neglect, or sexual assault. 

Under the Obama-era rule, nursing homes that accept clients sponsored by Medicare or Medicaid funds could not include contract language that required disputes be settled by a third party rather than the courts.
